1. Acceptance of Terms

By downloading, installing, or using BetaSweep ("the App," "the Service"), you ("User," "you") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, do not download or use the App. These Terms constitute the entire agreement between you and BetaSweep ("we," "us," "our") regarding your use of the Service.

2. Use of the App

You may use BetaSweep to scan websites you own, manage, or are authorized to test, or publicly accessible websites for legitimate analysis purposes. By using the App, you represent and warrant that:

  • You have the legal right to scan any website or URL submitted to the App
  • Your use complies with all applicable local, state, national, and international laws and regulations
  • You will not use the App for any unlawful, harmful, or unauthorized purpose
  • You will not attempt to reverse-engineer, decompile, modify, or redistribute the App except as expressly permitted by law

3. Scan Results — Important Limitations

BetaSweep provides automated analysis for informational purposes only. The results are not legal advice and are not a substitute for professional accessibility consulting or expert review.

Automated scanning cannot detect all accessibility barriers. Many accessibility issues require human judgment, assistive technology testing, or contextual evaluation that automated tools cannot perform. A passing score or absence of flagged issues does not mean a website is accessible, legally compliant, or free from barriers for users with disabilities.

Specifically, scan results:

  • Do not constitute legal compliance with the Americans with Disabilities Act (ADA), Section 508 of the Rehabilitation Act, the Web Content Accessibility Guidelines (WCAG), the European Accessibility Act, or any other accessibility law or standard in any jurisdiction
  • Do not replace a professional accessibility audit, remediation consultation, or legal advice from a qualified attorney
  • Do not guarantee that a website meets any regulatory, contractual, or technical standard
  • May be incomplete, inaccurate, or affected by page structure, dynamic content, third-party scripts, scan configuration, network conditions, or other factors outside our control
  • Reflect the state of a page at the time of scanning only and do not account for subsequent changes

You are solely responsible for how you interpret, act upon, or represent scan results — including any decisions made in reliance on those results. We expressly disclaim any liability arising from your use or reliance on scan output.

4. Third-Party Services

BetaSweep integrates third-party engines and services to deliver scan functionality, including but not limited to axe-core (Deque Systems), Google PageSpeed Insights, and html-validate. The accuracy, availability, and results of these integrations are subject to the limitations and terms of their respective providers. We make no warranty regarding the output of third-party components and are not responsible for errors, changes, or service interruptions affecting those components.

5. Intellectual Property

BetaSweep, including all related software, design, branding, documentation, and scan output formats, is the intellectual property of its creator. No rights are transferred to you by use of the App. You may not copy, modify, sublicense, sell, or redistribute any portion of the App or its components except as expressly permitted by applicable law.

6. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BETASWEEP AND ITS CREATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, LOSS OF GOODWILL, LEGAL COSTS, REGULATORY PENALTIES, OR ACCESSIBILITY-RELATED CLAIMS — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.

Some jurisdictions do not permit certain limitations of liability; in such cases, liability is limited to the fullest extent permitted by law.

8. Indemnification

You agree to indemnify, defend, and hold harmless BetaSweep and its creator from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your use of the App
  • Your violation of these Terms
  • Your scanning of websites without proper authorization
  • Your reliance on scan results in any legal, regulatory, or professional context

9. Pricing

During the current free access period, the App is available at no cost. Pricing, licensing terms, and access models are subject to change. Continued use of the App following any pricing change constitutes acceptance of the updated terms.

10. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be communicated via the App or our website. Continued use of the App after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to updated Terms, discontinue use of the App.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your State/Jurisdiction], without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in [Your County/City, State].

12. Severability
